BOOKING TERMS

Welcome to Park House Opera’s (“PHO”) event booking system which is a ticketing and registration platform to manage our events.

Detailed below are the terms and conditions (“Terms” and “Conditions”) on which we sell tickets to you via our website.

On purchasing tickets you will need to confirm acceptance of the Terms so please ensure you have read and understood them before finalising your booking.

 

1. Who we are and contact

1.1  www.parkhouseopera. com is a site operated by Robert and Samantha Salvoni in partnership with Duchy Opera Trust Limited (“DOT”), a registered charity with charity number 285212. Park House Opera PHO) operates on a not-for-profit basis, and is a trading arm of Park House Ventures Ltd. which will be in receipt of all payments. All suppliers (including donations to Duchy Opera Trust) will be paid by Park House Ventures Ltd.

1.2 Contacting us

We can be contacted by email at robert.salvoni@parkhouseventures.com. If we have to contact you or give you notice in writing, we will do so by e-mail or by post to the address you provide to us in your order.

 

2. Contract

2.1 When you receive confirmation of your booking, you will enter into a contract with Park House Ventures Ltd. based on these Terms.

2.2 Tickets are sold subject to our right to make any alterations in the cast or performance details advertised on our website or other relevant location although every endeavour will be made to provide the offer as advertised.

2.3  Tickets are sold for private use only. You agree under these Terms not to use the Tickets for any commercial or business purposes.

2.4 If we are unable to supply you with Tickets, for example because a performance has been cancelled, we will inform you of this by e-mail and we will not process your order. If you have already paid for the Tickets, we will contact you in order to refund you the full amount including any delivery costs charged as soon as possible.

2.5. Once the performances have been sold out, we will not process your order, but may offer you a place on the waiting list should tickets become available.

3. Variation of Terms

Although these terms many vary from time to time, the Terms in force at the time of each booking you make will apply to that contract between you and us (see 2 above).

4. Audience Seating area

4.1 Tickets purchased online are for the unreserved seats. Some seats will be allocated to people with access issues, sponsors etc., and these will be clearly indicated as “reserved”. Unreserved seats are allocated on a first come, first served basis when the event opens.

4.2 Children under the age of 16 must be accompanied by an adult.

4.3 We regret that no dogs (except guide dogs) will be admitted into the auditorium seating area of the event. Please inform us at the time of booking if you need to bring a guide dog or have any other accessibility needs.

4.4 Umbrellas cannot be used in the seating area during a performance as it will restrict the view for others.

4.4 We reserve the right to refuse admission and can ask any Ticket holders to leave if necessary (and take any appropriate action to enforce this right) both before or during performances. This action will only be taken if the individual’s behaviour is considered detrimental to the other guests enjoyment of the performance by the organisers.

4.5 Those arriving after the performance has started may be asked to wait until a suitable break in the performance before being admitted.

4.6 All electronic equipment, including mobile phones must be switched off during performances.

4.7 There is not planned to be any specific space allocated for children’s buggies and child seats in the seating area. If this is a particular requirement and you consider it unavoidable, please let us know in advance, and we will endeavour to accommodate if at all possible.

4.8 Strobe lighting, smoke effects and loud sound effects are sometimes used in productions.

4.9 We, and authorised third parties may film and record sound in or about the venue. By purchasing Tickets, you consent to you and your party being included in these films and recordings and to the commercial exploitation of such films and recordings without payment. It is your responsibility to inform a member of staff at the event if you do not want to be filmed or photographed.

5. Venue provisions

5.1 Smoking or the use of electronic cigarettes is not permitted anywhere at the Venue.

5.2 You are not permitted to bring alcohol into the Venue.  Only alcohol purchased at the Venue to be consumed.

5.3 On the Friday and Saturday night, you are not permitted to bring food into the Venue as the event is fully catered.  On the Wednesday you are welcome to bring your own picnic in to the Venue.

6. Cancellation and refunds

6.1 Refunds are only provided if a performance is cancelled. Performances will not generally be cancelled because of weather conditions and will continue in wet weather. The decision to cancel a performance due to the weather is made at our discretion.

6.2 If the performance is cancelled prior to the start of the event, we will refund you the face value of the Tickets.

6.3 If the performance is cancelled when less than half the performance has taken place, we will refund to you the face value of the Tickets purchased (minus the cost of any catering consumed on the feast nights).

6.4 Where a performance has been cancelled when more than half of the performance has taken place we may, at our discretion, refund to you the face value of the Tickets purchased (minus the cost of any catering consumed on the feast nights).

6.5 We will refund you using the method of payment you used to purchase the Tickets.

6.6 As a consumer, you have legal rights in relation to Tickets that are not as described. These legal rights are not affected by anything in these Terms.

7. Online Ticket Booking

7.1 Tickets are sold at the prices displayed for the relevant performance and you authorise the amount payable for them to be debited immediately from your credit or debit card by PHO as the payment provider. By requesting tickets through the Website you are placing a booking request for them on these Terms which are only accepted and binding on us once we have debited your card and sent you a confirmation booking reference which will be displayed on your screen and emailed to you.

7.2 Once a booking is confirmed the ticket is non refundable.

7.2 Prior to the event we will email you your tickets. Tickets purchased will be emailed to the email address provided at the time of sale and should be shown at the entrance to the event on a printed page or on a mobile phone, tablet or other device for checking. Mobile signal is not guaranteed at the venue so tickets shown on a mobile device should be saved as a PDF or screenshot prior to arrival. Customers arriving without a valid copy of their ticket may be refused entry.

8. Liability

8.1 If we fail to comply with these Terms, we are only responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failure to use reasonable care and skill. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.

8.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes:

·       liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors

·       liability for fraud or fraudulent misrepresentation.

8.3 Except for certain liabilities which cannot be limited at law (and which this Agreement does not seek to limit) our total liability under or in connection with this Agreement will in all circumstances, be limited to 100% of the ticket price paid to us at the date on which the performance giving rise to liability occurred.

8.4 If you breach your obligations under these Terms, we may seek compensation from you for any losses we incur.

9. General

9.1 We may transfer our rights and obligations under these Terms to another organisation. We will always tell you if this happens and we will ensure that the transfer will not affect your rights under the contract. You may only transfer your rights or your obligations under these terms to another person or organisation if we agree to this in writing.

9.2 This contract is between you and PHO. No other person will have any rights to enforce any of its terms.

9.3 Any notice given under the Terms will be in writing and made to the relevant address or email address detailed on the website or in 1.2 above.

9.4 These Terms are governed by the Law of England and Wales any disputes in connection with the Terms will be subject to the non-exclusive jurisdiction of the courts of England and Wales.

10. Refund Policy for merchandise purchased online

Thank you for shopping with us. If you are not entirely satisfied with your purchase, we're here to help.

Purchase online and Collect at Opera Orders

This service allows you to order merchandise online and pick them up at Park House Opera during the event. The following refund policy applies to purchases made through this service.

10.1 Returns

You have 14 calendar days to return an item from the date you received it. To be eligible for a return, your item must be unused and in the same condition that you received it. Your item must be in the original packaging and needs to have the receipt or proof of purchase.

10.2 Refunds

Once we receive your item, we will inspect it and notify you on the status of your refund. If your return is approved, we will initiate a refund to your original method of payment. You will receive the credit within a certain amount of days, depending on your card issuer's policies.

10.3 Shipping

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

 OTHER INFORMATION

Park House

What time does it open?
Park House will open at 5.30pm on Wednesday 20th July 2022 and 4.30pm on Friday and Saturday 22nd and 23rd July 2022.

Performances will commence promptly at 7pm on each day, so please leave plenty of time, as you may not otherwise be able to get to your seat once the performance has started.
Those arriving before the garden opens will be asked to remain in the car park area. 

How do I get there?
Postcode: TR1 1SX – NB. The postcode can be misleading with many satnavs, so please follow the instructions below.

Please approach via Truro Trafalgar Roundabout, up St Clement’s Hill past Truro School. Turn Right towards St Clement at the top of the hill. Proceed towards St Clement, and turn right into a Public Byway once you have passed “Doorstop Ltd” on the right. The venue will be signposted on the day of the event. The Public Byway is narrow, so we will be operating a one-way system. Please DO NOT come to Park House via the Private Road from Sunny Corner on the Malpas Road.

If you are being collected by car after the performance, drivers should arrive no later than 11.00pm. 

Is parking available?
Free parking is available, you will be directed when you arrive. 

There are a limited number of parking spaces for the use of those with accessibility requirements. These must be booked in advance by informing us at time of booking or thereafter by email. 

What happens in bad weather? 
There are no changes to the schedule in bad weather however please bring adequate clothing. The audience will be seated on chairs on grass so it is inadvisable to wear stilettos or kitten heels.

Please note use of umbrellas during the performance is not permitted.

The performance will only be abandoned and ticket refunds considered should the weather conditions be considered by the organisers to be dangerous for audience or performers, please refer to clause 6 of the Booking Terms.

Dining

What dining arrangements do I need to make?
Tuesday & Wednesday - Please feel free to bring a picnic, or you can purchase a bowl of pasta from The Cornish Italian, but please, no alcohol, as the bar will be open before and an hour after the performance.

Friday and Saturday - Before the performance food and drink is served in the Walled Garden, and the bar will remain open an hour after the performance.

There is a pay-bar available before and (an hour) after the performance as well as in the interval. You will also be able to pre-order drinks for the interval at the bar prior to the performance.
